General Terms of Use

1. Scope

These General Terms of Use (hereinafter the “ToU”) apply to any visit to or use of the Platform and its information by an internet user (hereinafter the “User”).

By visiting or using the Platform, the User acknowledges having read these ToU and expressly accepts the rights and obligations set out herein.

Exceptions to the provisions of the ToU may be made by written agreement. Such exceptions may involve the modification, addition or removal of specific clauses and shall not affect the application of the remaining provisions.

We reserve the right to amend these ToU at any time without prior notice. However, the provisions applicable shall be those in force at the time the Platform is used.

2. Platform

a. Access and navigation

We take all reasonable and necessary measures to ensure the proper functioning, security and accessibility of our Platform. However, we cannot guarantee absolute operability, and our obligations must therefore be understood as best-efforts obligations.

Use of the Platform is at the User’s own risk. We shall not be held liable for any damage resulting from possible malfunctions, interruptions, defects or harmful elements present on the Platform.

We reserve the right to restrict access to the Platform or to interrupt its operation at any time, without prior notice.

b. Content

Myriam Zahri largely determines the content of the Platform and takes great care in the information provided. We make every effort to ensure that the Platform is as complete, accurate and up to date as possible, even when information is provided by third parties. We reserve the right to modify, supplement or delete the Platform and its content at any time, without liability.

Myriam Zahri does not guarantee the absolute quality of the information on the Platform. It may not always be complete, accurate, sufficiently precise or up to date. Accordingly, Myriam Zahri shall not be held liable for any direct or indirect damage suffered by the User as a result of such information.

If any content on the Platform is unlawful, infringes third-party rights or is contrary to public morals, please inform us as soon as possible by email so that appropriate action can be taken.

Any download from the Platform is at the User’s own risk. Myriam Zahri shall not be held liable for any direct or indirect damage resulting from such downloads, including data loss or damage to the User’s computer system.

c. Links to third-party websites

The Platform may contain links or hyperlinks to external websites. Such links do not automatically imply any relationship between Myriam Zahri and the external site, nor any implicit approval of its content.

Myriam Zahri exercises no control over external websites and therefore cannot guarantee their proper or secure functioning. Once the User clicks on a hyperlink, they leave the Platform. We cannot be held liable for any resulting damage.

4. Intellectual Property

The structure of the Platform, as well as all texts, graphics, images, photographs, sounds, videos, databases, software applications and other elements composing or accessible via the Platform, are the property of the publisher and are protected by applicable intellectual property laws.

Any representation, reproduction, adaptation or exploitation, in whole or in part, of the Platform’s content, trademarks or services, by any means whatsoever, without the prior written consent of the publisher, is strictly prohibited, except for elements expressly designated as free to use.

The User is granted a limited right of access, use and display of the Platform and its content. This right is non-exclusive, non-transferable and strictly limited to personal, non-commercial use. Unless prior written consent is obtained, Users are not permitted to modify, reproduce, translate, distribute, sell or communicate to the public any protected elements, in whole or in part.

The User is prohibited from introducing data onto the Platform that would modify or potentially alter its content or appearance.

5. Personal Data Protection

The personal data provided by the User during their visit to or use of the Platform is collected and processed by Myriam Zahri exclusively for internal purposes. Myriam Zahri assures its users that it attaches the utmost importance to the protection of their privacy and personal data, and that it is committed to clear and transparent communication on this matter.

Myriam Zahri undertakes to comply with applicable legislation, namely the Law of 8 December 1992 on the protection of privacy in relation to the processing of personal data, as well as the European Regulation of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

The User’s personal data is processed in accordance with the Privacy Policy available on the Platform.

6. General Provisions

Myriam Zahri reserves the right to modify, extend, delete, limit or suspend the Platform and its associated services at any time, without prior notice and without liability.

In the event of a breach of the ToU by the User, Myriam Zahri reserves the right to take appropriate sanction and remedial measures. In particular, Myriam Zahri may refuse the User access to the Platform or its services, temporarily or permanently. Such measures may be taken without prior notice or justification and shall not give rise to any liability or compensation.

If any provision of these ToU is found to be illegal or invalid, this shall not affect the validity or application of the remaining provisions. In such a case, we reserve the right to replace the invalid provision with a valid one of similar scope.
